- In consideration of acceptance of my entry into the Purina Pro Plan Incredible Dog Challenge (“Event”), a special event where both canines and their trainers/owners, will compete in one or more of the following events: Incredible Agility, Incredible Freestyle Flying Disc, Incredible Diving Dog, Incredible 30-Weave Up-and-Back Racing, Surf Dog and Incredible Fetch It! I the undersigned, (“Participant”):
- Hereby agree to release and hold harmless Carson International, Nestlé Purina PetCare, the event sponsor(s), host site(s), and all persons associated with the Event, from and against any and all liability, claims, damages, suits, actions, judgments, and/or expenses whatsoever, arising out of or in any way connected with participation by me and/or my dog in the Event, including but not limited to any and all personal injuries sustained by me and/or my dog and/or any and all damages to personal property associated therewith.
- Hereby authorize Carson International, its subsidiaries, affiliates, divisions, successors, licensees, and assigns and those acting under its permission and on its authority (hereinafter “Carson”), to copyright, use, and publish, on a world-wide basis, in perpetuity, any photographs, negatives, film/videotape and/or reproductions of me and/or my dog taken at the Event, in whole or in part, in composite or distorted character or form or as otherwise changed, or reproductions thereof, in color or otherwise, made through any medium whatsoever, with a real or fictitious name, now or at any time in the future.
- Hereby grant, assign and transfer to Carson all rights of every nature relating to the reproduction and use of such photographs, negatives, film/videotape and/or reproductions, and hereby waive any rights that I may have with respect thereto pursuant to any statute or law.
- Hereby waive any and all rights I may have to inspect and/or approve such photographs, negatives, film/videotape and/or reproductions, any finished product relating thereto or the use to which it may be applied. I further agree that this Authorization and Release shall be binding on my heirs, successors, executors, administrators and assigns.
- In connection with the subject matter hereof, ownership of any photographs, negatives, film/videotape and/or reproductions taken of me and/or my dog by or on behalf of Carson or its representatives, shall be vested in Carson, and I agree to release Carson and its representatives from any and all liability in connections therewith.
- Hereby warrant that I am the legal owner of the dog participating in the Event herewith and that I have full power and authority to grant all authorizations and permissions conveyed herein.
- Hereby warrant that I am of legal age and have every right to contract in my own name and further that I have read the above authorization and release prior to its execution and that I am fully familiar with the contents thereof.
